Law Section
District Primary School Council has a Law Section. This law section supervises and disposes of the legal matter of all the Primary under this council along with all types of legap matter related to DPSC teacher as well as other matter like with DPSC, Burdwan. For example if a teacher was arrested and detained in jail custody for more than 48 hours, at first he/she shall have to inform authority concern of DPSC and on the basis of this a departmental proceeding is taken upon his/her and finally he/she is placed under order of suspension under the provision of service conduct rule of Primary teacher Rule-2001. At the time of suspension the teacher concern are entitled to get subsistence allowance as per extant rule-7(4) and after completion of judiciary proceeding if the victim teacher is not found guilty, he/she is re-instate in service on the basis of judgment passed by the Ld Lower Court as well as Hon’ble High Court at Kolkata. But if the teacher is found not acquitted this council terminates the accused teacher as per provision of Law. There are several cases in the Ld Lower Court as well as in Hon’ble High Court regarding died-in-harness matter, terminal benefit e.g Pension, Provident Fund and ‘A’ Category Scale of pay matter, Head Teacher transfer matter, recruitment of Primary Teacher and other matters allied to DPSC, Burdwan. The DPSC, Burdwan engages Advocate in its favourfor the case before the Hon’ble High Court, Kolkata in the Ld Lower Court. When a person or teacher files any case against council the law section of this council informs this to the civil suit section, office of the District Magistrate, Burdwan. The Chairman of this council has decided to do that for avoiding legal complication.
